GR successful in City of Burlington v. Burlington Airpark Inc. environmental claim

The legal team of Ian Blue and Anna Husa, including Law Clerk Linda Robinson, were successful in a significant decision representing the City of Burlington in Ontario Superior Court in a decision that was released on June 30, 2016. 

The application brought forward on behalf of the City alleged that a fill operation being carried on at Burlington Executive Airport had potential negative environmental impacts, including on the well-water of surrounding resident landowners.

The City served Airpark with an Order to Comply with its Topsoil and Preservation and Site Alteration By-Law. Airpark refused to do so on the basis that it did not need to comply because the fill operation pertained to airport expansion, which fell under federal, not provincial jurisdiction. The City brought an application to decide the issue and was successful. As of this date, Airpark has not appealed

GR successful in R. Comeau Decision in New Brunswick Provincial Court

Ian Blue, Q.C. was the head of the legal team, including Law Clerk Linda Robinson, on behalf of the Canadian Constitutional Foundation and Gerard Comeau that won R. Comeau in New Brunswick Provincial Court, in which the decision was released on April 29, 2016. 

In the decision, the court accepted virtually all of Ian’s Argument about the prober interpretation of s. 121 of the Constitution Act, 1867 in his two 2010 papers, Long Overdue: A reappraisal of s. 121 of the Constitution Act, 1867 and  Free Trade Within Canada: Goodbye to Gold Seal. The decision is carefully written, based on undisputed evidence and reasoned in a manner that will be difficult to overturn. 

In the decision the court concluded that s. 121 of the Constitution Act guarantees freedom from all trade barriers between the provinces and that the Supreme Court of Canada’s decision in Gold Seal Ltd. v. Alberta (Attorney-General), (1921), 62 S.C.R. 424 that held otherwise, and three Supreme Court of Canada decisions that followed it, were wrongly decided.
